Since the overturning of Roe v. Wade, Texas has outlawed abortion in its state. The only exceptions to this are if the health or life of the woman is at risk; the state finds this as an extraordinary circumstance that does warrant intervention to save the woman’s life.
What Did The Reversal Of Roe v. Wade Do?
After the historic Supreme Court decision in June of 2022, reversing Roe v. Wade, many Americans were left unsure how this would impact the United States.
Originally the 1973 decision stated it was a woman’s constitutional right to exercise if she chose to have an elective abortion without a life-threatening diagnosis behind her decision. However, when this ruling was overturned, the power to decide abortion laws was returned to the people. Now, each state will determine its restrictions and how to regulate abortion within its territories.
Now people of each state can elect individuals that represent their views and who will speak on their behalf on this issue.
Will Ectopic Pregnancies and Miscarriages Still Be Treated?
Treatment for ectopic pregnancies and miscarriages will still be available and legal within the states that have outlawed abortion, including Texas. Since these pregnancy complications are inevitable and can cause serious injury to a woman’s health, legal treatment cannot be denied by state law.
It’s important to note there is a difference between these treatments and induced abortions because the definitions behind each vary.
According to the University of Missouri’s School of Medicine, “Induced abortions are commonly voluntary (elective). Induced, elective abortion is in contrast to spontaneous abortion, or miscarriage, in which the embryo or fetus is involuntarily expelled because of accidental trauma or disease.”
Lastly, Patricia Santiago-Munoz, M.D. states, “Ectopic pregnancy treatment is not the same as abortion. The medical definition of “abortion” is the removal of an embryo and placenta from the uterus.” An ectopic pregnancy does not occur within the uterus but outside it.
